BATTLE CREEK (WTVB) - It’s another piece to the puzzle as the state and the courts sort out the boundaries of Michigan’s medical marijuana law.

A federal judge has ruled that permitted Marijuana users may be protected from the sanctions of the law, if they have the proper paperwork, but not from the sanctions or policies of their employers.

Joseph Casias, who worked at Walmart in Battle Creek and was a model employee, brought the suit after he failed a screen for marijuana.  He had all the proper permits, but the retailer said it was against their policy.

Federal Judge Robert Jonker says the law doesn’t say anything about private employment practices.

Casias, who suffers from an inoperable brain tumor, was advised to try medical marijuana by his doctor. It means he is out of a job.

There could be an appeal.
