Kalamazoo City officials have a decision to make on reinstating Same Sex benefits in the wake of a Federal Judge's ruling that a state ban is unconstitutional.

KALAMAZOO (WKZO) -- The City of Kalamazoo was among a handful of local towns and schools that offered same sex benefits before the legislature banned school districts and municipalities from offering the benefits in 2012.

In fact a Kalamazoo City employee and her partner joined the lawsuit challenging the ban.

The ACLU’s Michael Steinberg says now Judge David Lawson has issued an injunction, with a lengthy statement stating that the plaintiffs made a convincing argument that the law violates the Equal Protection Clause of the Constitution.

Steinberg thinks it will hold up after further arguments and challenges.

Kalamazoo Personnel Director Jerome Post says they just learned about the ruling and haven’t discussed whether they will reinstate the benefit.

It could still be subject to an appeal from the state.
