Federal Judge poised to make a decision on Michigan's ban on Same Sex Marriage

DETROIT (WKZO)  -- A federal judge could lift Michigan’s voter approved ban on same-sex marriage today after hearing arguments on the constitutionality of the law, or not.

Judge Bernard Friedman could just as easily rule otherwise or not issue a ruling at all. He could lift the ban, and then immediately stay himself, knowing that it will be appealed.

Some county clerks are ready to start issuing Marriage Licenses, if a legal window opens.

Others will wait for the Michigan Dept. of Community health to generate new applications and get instructions on how to handle them..

Kalamazoo County Attorney Thom Canny says that could take a few days.

Allegan’s County Clerk says he won’t issue them.

The case began as a challenge by gay parents who wanted to adopt the children of their life partners, but the same ban impacted them.

If it’s unconstitutional in that case, it’s unconstitutional for all reasons.

Don’t order the wedding cake or book the honeymoon just yet.
