DETROIT (WKZO) -- The committee representing City of Detroit retirees wants a U.S. District Court judge to answer questions regarding whether the city's filing for bankruptcy is constitutional.  In a motion filed Wednesday, the committee is asking for the matter to be removed from the jurisdiction of U.S. Bankruptcy Judge Steven Rhodes, citing legal issues.

The retiree committee claims the Chapter 9 filing violates the state constitution's protection of pensions and that Michigan's emergency manager law, which was used to authorize the filing, is unconstitutional because it takes away voters rights to elect their representatives.
