FENNVILLE (WKZO) -- A lawsuit will go forward in the New Year against Birds Eye Food regarding its food processing plant in Fennville and allegations that it tainted the water wells of its neighbors.
The case will go to trial on February 25, 2014 with three families suing the company over its use of wastewater to irrigate fields around the facility.
The company paid to switch all nearby homes to city water in 2011 and agreed to build a wastewater treatment system in 2010. But a federal judge in Kalamazoo has determined that three families have raised factual issues about their property values going down and plumbing damage to their homes.
A fourth plaintiff had their case dismissed because the judge ruled they couldn't prove thecontaminated water reached their property.
They had sued claiming the water led to illness and disabilities in the family.
Over the past 30 years, the wastewater from the plant put high levels of iron, sodium and arsenic inthe groundwater.
