KALAMAZOO (WKZO) -- The Kalamazoo Department of Public Safety has decided not to seek charges against a man who appeared to be irrational, intoxicated and carrying an AR-15 semi-automatic rifle down Cork Street last Sunday, claiming to be testing the state’s “open-carry” gun laws.
They had considered taking a case of brandishing a weapon to the prosecutor but decided there wasn’t enough evidence.
Chief Jeff Hadley says the man was quite belligerent.
It’s illegal in Michigan to be in possession of a weapon while intoxicated.
Just one beer is enough to have your gun confiscated, usually it’s a misdemeanor but in some cases it’s a felony. But they can’t prove that either because they didn’t do any testing.
The man refused to take a breathalyzer test.
The man retrieved his gun from Public Safety headquarters on Monday.
