BURLINGTON (WKZO) -- For a second time, Lorinda Swain’s case and her freedom have been left to a panel of three state appellate court judges to decide.

The Calhoun County woman was convicted of criminal sexual conduct in 2002 after her adopted son accused her of molesting him. He has since recanted that story.

That led to her being released for a new trial after 7 years in prison. But the prosecutor appealed and won.

Since then new evidence demonstrating her innocence has been presented, leading to a second order for a new trial, and a new appeal.

Yesterday the Appellate Court Judges heard arguments and Swain and her attorneys will now wait for a ruling.

Whichever side loses, more appeals are expected.
