MARSHALL, MI (WTVB) – Enbridge may not have spent its last dollars on the aftermath of that huge oil spill in Calhoun County after all, if Chance Lowery gets his way. Lowery sued the pipeline firm, claiming that intense coughing and vomiting from fumes emitted by the crude oil spill on the Kalamazoo River, resulted in a ruptured short gastric artery that required repair and generated some serious medical bills. His case was dismissed by the Trial Court because Lowery used his family physician as his expert, and Enbridge challenged his credentials as inadequate. The Court of Appeals has now disagreed and sent the suit back to trial court for further proceedings.
