LANSING (WKZO-AM) — When the lawyers for Lorinda Swain walk into the Michigan Supreme Court to make their arguments Wednesday morning, they will have the support of some influential backers.
David Moran with the Michigan Innocence Project says a number of prosecutors, two former U.S. attornies, a former President of the Michigan Bar Association, and even a former Calhoun County prosecutor has submitted a friend of the court brief supporting their position.
Moran says they aren’t asking for Swain to be exonerated. They are asking that she be retried and, if the Calhoun County prosecutor is so certain the case against her is solid, then justice should be served.
Moran claims Swain was the victim of ineffective council and prosecutors who failed to hand over all the potential evidence that might exonerate the Burlington woman, who was charged with sexually abusing her adopted son.
That son has since recanted, and other witnesses have come forward who did not testify at her trial.
Oral arguments will be heard Wednesday. It may take a few months for the justices to issue an opinion.
