LANSING, MI (WTVB) – Arguments will be heard this morning to settle the case of Lorinda Swain, the Calhoun County woman who spent seven years in a state prison for a crime she says she did not commit and the last seven years free on appeal because a Battle Creek Circuit Court Judge also feels she is innocent.
Calhoun County Prosecutors have fought tooth and nail to have her conviction upheld, apparently unwilling to admit that their office could make a mistake. The prime witness against Swain, her adopted son has since recanted his story.
Prosecutor Dan Gilbert says he did it under pressure from the family, and it’s not credible.
But David Moran with the Michigan Innocence Project says Gilbert has refused to meet with Ronnie Swain.
The State Supreme Court adjourns mid-summer and a decision is expected by then.
