ALBION, MI (WTVB) – The family of a 13-year-old boy with mental health problems has filed a civil lawsuit seeking $10 million dollars in damages for alleged civil rights violations by a former Albion police officer.
The Battle Creek Enquirer reports the suit names the City of Albion, Police Chief Scott Kipp and former police officer Tyler Collins as defendants.
A demonstration was held in Albion last week. Protests began when videos of the alleged assault went public. They show an Albion police officer punching the boy as he sat prone with his hands cuffed behind his back in the rear seat of a police cruiser.
Collins was fired months ago but he was not charged by Calhoun County Prosecutors David Gilbert in connection with the incident.
The Enquirer reports that according to Gilbert, the youngster threatened to stab family members with a pen and had kicked and spat at officers as he acted up in the police cruiser.
